These terms govern your use of Pothos (the "App"). By downloading or using Pothos, you agree to these terms.
This agreement is between you and Kingston Preest only, not Apple, and Apple is not a party to it. Kingston Preest, not Apple, is solely responsible for the App and its content.
Kingston Preest grants you a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by Apple's Usage Rules set out in the App Store Terms of Service — including use by other members of your household under Family Sharing or on multiple devices you own, where Apple's rules allow it.
Kingston Preest is solely responsible for providing any maintenance or support for the App. Apple has no obligation to furnish any maintenance or support with respect to the App.
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied. Pothos is currently free, so there is no purchase price for Apple to refund today; if Pothos later offers paid features and one fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for that item to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty are Kingston Preest's sole responsibility, not Apple's. Any such claim should be directed to Kingston Preest through the contact method below.
Kingston Preest, not Apple, is responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
In the event of any third-party claim that the App, or your possession and use of the App, infringes that third party's intellectual property rights, Kingston Preest, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
The quotes in Pothos's library are curated for display within the App and attributed to their original speakers or authors. This content is provided for your personal, in-app use and is not licensed to you for redistribution, republication, or commercial use outside the App.
By using the App, you represent and warrant that you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Pothos is developed by Kingston Preest, based in Glendale, Arizona, USA. Questions, complaints, or claims regarding the App should be sent through the in-app feedback form — that is the channel we monitor for exactly this purpose.
When using the App, you must comply with the terms of any applicable third-party agreements to which you are a party — for example, your wireless carrier's data plan terms — as they may affect your use of the App.
You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this agreement, and that, upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this agreement against you as a third-party beneficiary of it.
If you write and save your own quotes within Pothos, that content is stored locally on your device. You are responsible for what you write and save. We do not review, moderate, or have access to quotes you create for yourself.
Pothos is currently free to download and use, with no in-app purchases or subscriptions. This may change in a future version of the App, in which case any paid features will be clearly disclosed before purchase.
To the fullest extent permitted by law, Kingston Preest is not liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the App.
You may stop using Pothos at any time by deleting the App. We may update, suspend, or discontinue any part of the App at our discretion.
These terms are governed by the laws of the State of Arizona, USA, without regard to its conflict-of-law principles, except to the extent superseded by the third-party beneficiary rights described above.
These terms may be updated from time to time alongside changes to the App. Continued use of Pothos after an update constitutes acceptance of the revised terms.
